An award-winning Hong Kong photographer has been sentenced to eight weeks in prison for indecently assaulting a female model two years ago.
Eastern Court on Wednesday granted defendant Leung Chun-chung bail, which the 39-year-old applied for immediately after learning about his sentence. He is appealing against the conviction.
Leung was found guilty of pulling down the model’s dress and exposing her breasts at his Chai Wan studio on the night of December 16, 2022, an offence he denied.
The victim testified that she trusted Leung as an award-winning photographer who had collaborated with celebrities in Hong Kong and followed his requests for posing.
She told the court that Leung had asked her not to wear pasties to cover her nipples and made her take off her undergarments for “natural effect”.
The model recounted how Leung had suddenly pulled down her dress and exposed her breasts to the camera without her consent.
Magistrate Minnie Wat Lai-man said the offence involved a breach of trust and an abuse of the victim’s vulnerability, as she thought she was in good hands with a “master photographer” and agreed to come for the shoot at night.
The magistrate slammed Leung for having no remorse for what he did to the victim and for making her go through the traumatic event one more time by testifying in court.
“The psychological report of the victim showed that she had been blaming herself for what had happened and lived in fear over being secretly photographed or having her intimate pictures taken,” Wat said in sentencing.
She added the defendant should be the one to be blamed for his own “selfish acts”.
The defence said that, unlike other sexual assault cases, Leung had made contact with the victim’s back but did not touch her breasts.
The lawyer asked the court to consider imposing a two-week jail term, which was the same period Leung had been remanded, saying the defendant was no longer be able to work as a photographer and had learned his lesson after ruining his career.
But Wat insisted the crime was serious and set the starting point at eight weeks in jail, with no mitigation reasons given to reduce the sentence.
