A pro-democracy activist who threw eggs at Financial Secretary John Tsang Chun-wah during a 2013 political forum in North Point must serve his sentence of three weeks in jail, after a judge refused to quash his conviction for assault yesterday.

Derek Chan Tak-cheung, secretary general of the League of Social Democrats, had shown no remorse for his actions, Mr Justice Derek Pang Wai-cheong wrote in his judgment.

Contrary to Chan's claim, he was aiming at Tsang when he hurled two eggs at the stage, the judge concluded. One of the eggs struck Tsang's forehead.

The act "must contain an intention to 'assault' as the charge required", Pang wrote, upholding the ruling a magistrate made in November.

Chan, 25, was appealing against his conviction and sentence for one count of common assault over the December 7, 2013, incident at a public district discussion about the city's budget in Java Road.

Outside the High Court, league vice-president Raphael Wong Ho-ming said: "Our party and Chan are prepared for this outcome."
